Pirate’s Bay, are they real pirates or legal commercialists?

Let’s remind the pre-history of the conflict:
Some anti-pirate organizations that represent recording and moviemaking industry sent a complaint to Sweden Minister of Communications against ThePirateBay torrent portal and asked to arrange a demonstrative process in order to teach a lesson the whole world.
In the accusal there is lot of commercial products that were downloaded illegally with ThePirateBay help. The plaintiff in the present case are Warner Bros. Entertainment, MGM Pictures, Colombia Pictures Industries, 20th Century Fox Films, Sony BMG, Universal and EMI Group. Now according to the accusal procedure these companies must lay the claim about indemnity installment.
Actually the topic of fighting against the piracy was, is and will be actual always, but this case is special because a number of experts claim that to stop ThePirateBay under the Court decision will be impossible because from the technical side website is hosted on several servers placed in different countries. And besides they do not have the pirate products, the user gets only the torrent but not the program, movie etc itself, it is as if they described the way how to get to the store with pirate products, but not to give these products.
After the Court decision ThePirateBay was closed for the couple of days but nevertheless these days on the largest torrent-tracker ThePirateBay number of the torrents crossed 1 million torrents and the number of users is more than 10 millions.
So did they really commit a crime or they just are the perfect Market Specialists?
